Although it is highly preferable to arrive at a legal separation agreement or divorce settlement through some form of mediation, there are times when a couple cannot reach an agreement and the case simply must go to trial.

If you decide to have a trial, you must first fully realize that it is unlikely to be an easy divorce. Additionally, with lawyers fees on the rise, say goodbye to the idea of having a low cost divorce and to thousands of dollars of your hard-earned money. Be prepared to postpone your life after divorce for another year, and possibly longer. In some states, judges have been known to take more than a year to even assign a court date.

Remember that a divorce trial is public. Be on time and try to behave with dignity. Resist the temptation to get angry and emotional.

Join a support group. Doing this will help you to work out the emotional stuff outside of the courtroom and outside of your lawyers consultation time.

Speak clearly and audibly. If your words cannot be heard by everyone in the courtroom, you may be asked to repeat what you said.

Coping with divorce is often more difficult for those who need to have a trial. If there is still a possibility for mediation, do your best to work with your spouse and with both of your attorneys. At best, the professionals that you and your spouse hired are trying to offer their best divorce help to all concerned.

6 Emotional Phases of Divorce: The Healing Process

Phase One: Fear

I was married for sixteen years. My whole life revolved around my husband and my daughter. When my marriage fell apart, I did not have much of a support system in place. After the tears subsided somewhat and reality set in; I was what I feared most in my life, a divorced single mom. A gut wrenching feeling of fear set in.

Fear Defined

What is fear? Rhonda Britten author of Fearless Living defines fear as \”… both the cause and effect of the feelings, thoughts, or actions that prohibit you from accepting yourself and realizing your full potential. It is the gate keeper of your comfort zone\”. If you look at fear as an acronym, false evidence appearing real, it is much easier to face. If whatever it is that you are afraid of is really false then you can set it aside or move through it. Now doesn\’t that make life seem simpler?

Facing One of Your Biggest Fears: Failure

The best way I have found to combat fear is to just face it head on and move through it. Many people are fearful of failure. I say define failure. Just because you do not achieve what you set out to, does it mean you failed or does it mean that you were just not meant to achieve that particular goal? When you are in a situation where you feel you failed, ask yourself what was it that I gained or learned? You can always learn from it, so in essence it can not be a failure then, can it?

If nothing else you should congratulate yourself for taking the risk. Many people are too paralyzed by fear that they are unwilling to take the risk. The fact that you took the risk is worthy of praise and admiration. If you are afraid to try something because you might fail, think about the worse case scenario then ask yourself; if I do this will I survive? Unless the worse case scenario is death, you can survive so just do-it; \”what doesn\’t kill you makes you stronger\”.

A great story depicting this very thing can be found in Dale Carnegie\’s book \”How to Stop Worrying and Start Living\”. You will be amazed how great you feel for taking the risk.

As we all know that divorce brings you to that stage of life where you logically die even-though if you are physically alive. Or in other words divorce is death of a marital relationship. The impact that the reek of divorce brings along with it undeniably destroys one so badly that s/he might take years to get back on feet.

Earlier what we discussed was the emotional cost of divorce that is incurred in shape of death of love and loss of respect, isolation, stress, restlessness, developmental regression, physical deterioration, low self-esteem, absence of trust, cynicism, anger, bitterness, feelings of inadequacy any many more.

I want to get separated from my spouse, we dont have compatibility or we dont make a good match are the frequent phrases that we hear from young married couples today. Well, this group of people has set of mind which tells them that by getting divorced they are putting an END to the marital unhappiness and with divorce they can rid the tyranny, oppression and abuse of the spouse. But literally speaking they are simply replacing a set of problem with another especially in cases where minors are involved. You will find them coming out of divorce entirely different and their life will take a counter-turn.

Relating back to the previous topic, a question arises in our mind that why divorce, breakup, separation and unpleasant marital life are becoming so very common in the present world? Divorces did exist in the past but comparatively at a very small scale. This is so very obvious that children who see their parents getting divorced are growing as a broken generation having several sets of problems which becomes a part of their lives. They are further stained when their parents remarry. And very clearly when abused children grow up in an atmosphere where such treatments have become no problem now or more likely to say fashion, they will follow the same and will act accordingly when they will get married and thus the cycle continues. This is a very staggering cost that our whole nation is bearing.

We saw that the emotional toll of divorce is itself not less than any big loss but its financial costs are also hideous bringing devastating consequences.

There is growing government dread over soaring divorce costs. In United Kingdom, studies have shown that government provided legal aid alone of 178 million the previous year, out of which just 9.2 billion were spent helping people cope with the aftershocks of freedom. There were other costs that were spent on children care and the estimation was up to the 1.3 billion.

Whereas in the United States, the average divorce cost varies with estimation of $10,000 to 20,000. A recent study has provided an assessment that marriages that end in divorce are very costly to the public; furthermore, it was figured that a single divorce costs the federal governments about $30,000, based on things as the higher use of food stamps and public housing as well as increased bankruptcies and juvenile delinquency. The United States nation\’s 10.4 million divorces are estimated to have cost the taxpayers over $30 billion. Drilling down discretely, the cost that the taxpayer are paying off to the government includes child support enforcement cost of $37.7 million, domestic violence programs cost of $9.7 million and child abuse and neglect cost of $113.4 million whereas not including any welfare benefits to mothers who are dependent. If the divorce rates are reduced in any measurable fashion, it will save the taxpayers substantial dollars.

A sociology professor Steven Nock and U. Iowa Law and Economics professor Margaret Brinig were the first ones who studied this subject. They found out that as the divorce costs are too much for an ordinary person, the court proceedings may be stretched for a year or more. They also calculated that $175 billion is spent annually on divorce, mostly on litigation.

Divorce has become a very big and successful business in the United States. According to the information provided by a web- site that is geared toward divorce and remarriage, divorce is a $31 billion-a-year industry with an average cost of about $20,000.

Among many, one of the major reasons that are becoming recognized is the connection between the emotional pain of divorce and its impact on finances. No doubt, Divorce can lead to mental depression and emotional instability. It is studied that the rate of depression is nearly three times higher among divorced men and women than with married couples who have never divorced. When a spouse or both request for divorce, it is not uncommon to see job performance and productivity falls off dramatically between stress, lawyer meetings and time taken to build a new life. This will not be unwise to say that If you hire a divorce lawyer today, there is a good chance you will hire a bankruptcy lawyer within two or three years.

Divorce cost, whether emotional or financial, can be reduced substantially and kept under control if a spouse (petitioning for divorce) or both of them acknowledge the complete divorce process, make no haste and have control over their anger because in most of the cases divorce costs are heightened due to the destructive attitudes of the spouse towards the other making the process lengthier in terms of frequent sittings for counseling, consultation and other court proceedings.

The divorce costs can be further reduced financially by; revising your will carefully, taking existing insurance coverage in account, canceling all joint bank accounts (credit cards) and revising retirement assets.

Going not so far away from this miserable world of divorce, there are couples who are managing it out and like them very few are winners. Basically they are ones we should be looking at. The cost in emotional pain and suffering, as well as dollars and cents, can be extreme. The process may also go on for years. Still, by cooperating, understanding each other and learning the rules you both can come out in reasonably good shape.

If you\’ve got some years under your belt as a divorcee, you can probably see the patterns more easily than a new divorcee can. When you\’re new at it, it all looks like bubbling vegetable soup! What I discovered about myself through the process of divorce is what I\’d like to share with you in this article in the hope that you\’ll begin to see some of the way-markers and develop some confidence in yourself. You can certainly do it on your own, but a coach makes it much more simple.

If there was such a thing as a competition in life \’ such as Life versus You \’ and you adopted the habit of seeing life\’s experiences as such, you\’d get much more mileage out of what you now call problems or challenges. If you saw these challenges as a \”What the heck am I supposed to learn about myself now?,\” you\’d get more quickly to the learning and solve the problem more easily.

Let\’s suppose that all of these challenges are designed as learning tools so that you can figure out who you are, dig deeply into the wellspring of your own intrinsic nature, and bring up the very thing that will solve the problem. That would make you one heck of a source, wouldn\’t it? That would allow you to display self-sufficiency. It\’s one of the cheapest schools you can attend, this school of Life. The lessons come, you look inside yourself for the answers to the problems, you bring up from inside yourself whatever it takes to \”patch the holes,\” and you end up with whatever gpa you\’ve earned! Couldn\’t be any more handsomely designed. Convenient, inexpensive, instantly at hand. Who could want a keener brain child?

What it takes to adopt this kind of a mindset is to switch your focus from you looking outward to you looking inward. There is a whole world inside yourself that changing diapers, wiping snotty noses, fixing lunches, washing clothes on the weekends, dashing off to work after you drop the kids at school \’ all those jobs you are tasked with that keep you looking outward. If you can retrain yourself to look within, find out what the lesson of the day is, bring up the answer while you are wiping the noses and washing clothes, you and your children will benefit from your learning.

I\’ve heard in a sermon that while Jesus was carrying his cross, he fell face down in the dirt three times, but every time he stood up, he was a full body length ahead. Your emotional challenges and problems, courtesy of life and your divorce, can move you ahead too if you will look within for your answers. You can find the you who has enormous talents and capabilities to unfold, much more than you can see right now. You can destroy your sense of insecurity and indecision. You will develop strong mental muscles and because of this; you won\’t need advice from others, and you will become a strong parent for your children. They deserve as much. And if you learn how to do this, you can teach your children to see the things that happen in their lives as a lesson to be learned that will help them to unfold the wonders of their own individuality. Wow! Can you see our world\’s paradigm switching from leaning on others, entitlement, toward enjoyment and self-sufficiency. Now, aren\’t you glad you\’re divorced?

After you read The Summary Dissolution Booklet you will want to identify the appropriate superior court in California which to file the summary dissolution. Tennessee laws are based on what is in the best interests of the child, not the parents. The courts will decide whom your child will live with and the rules both you and your ex will be required to live by if you two cannot.

Tennessee does not want to make a custody decision; when relationships break down and couples break up the courts will review the agreement the parents have devised to custody of their child and unless it is not within factors custody is awarded then the courts make the decision, the parents agreement will almost always be enforced.

Here is a list of factors including but not limited to Tennessee courts they use to determine child custody. You and your ex should base child custody on what is in the best interests of the child and not personal reasons (I know that statement is almost impossible to ask, but it honestly is the right way). Factors Tennessee courts include but again are not limited to:

* Love, affection and emotional ties existing between the parents and child

* Disposition of the parents to provide the child with food, clothing, medical care, education and other necessary care and the degree to which a parent has been the primary caregiver

* Importance of continuity in the child\’s life and the length of time the child has lived in a stable, satisfactory environment

* Stability of the family unit of the parents

* Mental and physical health of the parents

* Home, school, and community record of the child

* The reasonable preference of the child if 12 years of age or older

* Physical or emotional abuse to the child, to the other parent or to any other person

* Character and behavior of any other person who resides in or frequents the home of a parent

* Each parent\’s past and potential for future performance of parenting responsibilities

\r These factors giving guidelines on determining custody are taken from Tennessee Code Title 36 Domestic Relations, Chapter 6 Child Custody and Visitation.

Tennessee law is divided into 2 categories; physical and legal custody.

* Physical means the actual living arrangements of the child and the rights and responsibilities associated on a daily basis.

* Legal means the responsibilities associated with making major decision regarding the child\’s health and welfare such as religious, education, and medical care.

\r Legal custody is divided into 2 categories:

Sole legal custody is when a parent is given the exclusive right to make the major decisions.

Joint legal custody is when both parents share in the major decisions of their child.

\r Physical custody is broken down into 5 categories:

Sole physical if awarded gives one parent the right for the child to live with them. This is not to common although it does happen. When this occurs the other parent usually receives generous visiting rights.

Joint physical when awarded allows both parents to share in decisions made for their child and/or physical control and custody.

Bird Nesting is when the child stays in the home and the parents take turns living in the house with the child (one parent at a time).

Split custody allows each parent to take custody of different children, this is not a popular choice.

Shared parenting is a rather new concept where parent\’s share legal and physical custody, there is no set agenda, what ever works for all involved.

\r Child custody is very rarely easy to agree on. Even the most trivial request can turn into a major debate.
